I started this as a project when I was enrolled in Paralegal Studies at SWIC, and it has since become a place for both paralegal students and other students of law to exchange information. First, the circumstances involving the ticket.

On Dec. 8, 2005, my wife was attempting to cross the intersection of Dielman Ind. Blvd. and Olive Blvd. Weather was bad; steady snow with about 3" accumulation at the time, windy and cold. She made it into the intersection and ended up behind another vehicle attempting to turn. In the mean-time, the light changed to yellow with her still in the intersection. She went around the non-moving car and proceeded through the intersection and turned into McDonalds parking lot, where she had time to turn off her car, put on her gloves and scarf before exiting. Once out of the car she proceeded towards the door of McDonalds and it was there that a man, who would later turn out to be Office Al Silverstein, Badge 161, of the City of Olivette, Missouri, would pull up in an unmarked car, displaying no badge and not in uniform, roll down his window and ask my wife if she was "in a hurry."
My wife did not know Officer Silverstein, nor have any reason to believe he has anyone other than a possible odd-ball engaging a woman walking across a parking lot with a bad pickup line. Since she was on foot, and trying to get out of the cold and snow, she replied she was in a hurry. It was then that Officer Silverstein engaged her about her crossing the intersection while the weather was bad and picked up his mike to call in her plates. She then asked him if he was going to give her a ticket, and he said yes. She tried to explain the situation, stating that she was in the middle of the intersection when the light was changing and Officer admitted that the light was changing.
My Wife was issued a citation, Number 050122271, which, according to the ticket, describes the offense as "Electric Signal s.bn.
There is a section on the ticket directly below that which reads, "Did then and there commit the following offense. The facts supporting this belief are as follows:"
There is absolutely NOTHING in that section proving any "facts".
A court appearance was set for Feb. 8, 2006 at 6:00pm in Olivette Municipal Court.
