News: Welcome to the Mark McCoy Paralegal and Legal Education Board. I started this as a project when I was enrolled in Paralegal Studies at SWIC, and it has since become a place for both paralegal students and other students of law to exchange information. This site has become quite popular with students at SWIC, and as a result has placed an unexpected burden upon the server. I am offering subscriptions for a semester worth of access for $10 to offset the additional server load and my time having to maintain this site. The site used to be maintained for free, but the number of people using this site has begun to take quite a bit of my time. To sign up, please click the PayPal link on this page: http://www.paralegal.markmccoy.com to make your payment and provide me a username and password. I'll set your site up and email you the information needed. Thanks, and good luck!

Hey guys,
Is anyone else (I'm representing the father) having difficulty finding relevant appellate cases in Illinois for this brief?
Just curious. I don't think I have to worry about going through 10 cases to review, that's for sure.

Mark - I'm also having trouble.  I think it would be much easier to take the Mother's side.  Everything I find seems to be more supportive of her.  I have a few cases that I downloaded but really haven't had the chance to read them - they seemed to help the Dad but none of them are Illinois cases.  Hopefully we'll get some help at class.  Sue

I'm finding very few, if any, Illinois cases, and making a stretch to apply them to the facts (or synthesize) to this case. I'm going to say something in class at the risk of incurring the bombastic wit of our instructor-in-chief.  ;)
I tried looking for "de novo review" and just "de novo" in general, but the courts don't specify the standard of review used in the case. It has to be extrapolated for the most part.
I'd be interested in swapping research trails with people to see what is being searched. Ugh!   :P

I am also having problems.  I represent Ellen and have been searching through Illinois cases.  Yikes!  I figured I would have tons to look through, but I'm only finding a few - but not real similar cases >:(

Yes!  I am also having trouble.  I cannot write either!  I am at a total standstill.  Can anyone help me.  I respresent the father also.  I am having trouble with everything.  For some reason I cannot find anything.  I actually have gotten to the point where I have just about given up.

Wow! This doesn't sound good.  :o
I'm behind as well. Usually, I keep up fairly well, but this is not right. Some of it is because of my schedule at work changing, but I'm tempted to just use the 4 cases we had to brief. I'm finding nothing that helps otherwise.
I'm hearing that a lot of us are having trouble.  Is it too late to drop and take it over? Does that count negatively on your transcript? I will probably turn this in on the very last day of class if I don't drop. I am not a happy man.

Don't give up and don't take this class over again!!!  What kind of torture are you into?!  I found a couple of things I think will work although I finally just buckled down and wrote something, don't care how good or bad it is, just wrote something.  Try these cases 144 Ill.App.3d 192; 660 F.Supp. 679; 286 Ill.App.3d 1020, 648 N.E.2d 50 (1997).  Those are a few that I found that I might use in addition to the ones he gave us.  I like the Whitehorse case.  I just want to get this thing written and done with.

Hey Jodi,
I have a couple of those. I like the Whitehorse case too.  ;D Here are a few I found pertaining to "Custodial Interference"

220 Ill.App.3d 185
273 Ill.App.3d 81
299 Ill.App.3d 732

One on "Parent & fear & harm & child & custody! & joint & protect!"
294 Ill.App.3d, 991

I'll check out the others you sent. Anything helps! Good luck!  :)
