News: Welcome to the Mark McCoy Paralegal and Legal Education Board. I started this as a project when I was enrolled in Paralegal Studies at SWIC, and it has since become a place for both paralegal students and other students of law to exchange information. This site has become quite popular with students at SWIC, and as a result has placed an unexpected burden upon the server. I am offering subscriptions for a semester worth of access for $10 to offset the additional server load and my time having to maintain this site. The site used to be maintained for free, but the number of people using this site has begun to take quite a bit of my time. To sign up, please click the PayPal link on this page: http://www.paralegal.markmccoy.com to make your payment and provide me a username and password. I'll set your site up and email you the information needed. Thanks, and good luck!

Questions for closed memo, Warren v. Buffton Motors
« on: February 02, 2006, 02:07:31 PM »

Question: Are we not just to focus on "intentional infliction of emotional distress" when briefing these cases, and disregard all other issues/sub-issues?
I know we're looking at IIED, but not sure whether we should completely disregard the other issues. I just don't feel like going through my tape recordings to listen for this instruction again. Any help? Thanks.

Mark - I thought we were only supposed to address the issue of conduct - whether the behavior would constitute outrageous conduct.  Have you heard from anyone else?  I have started my memo and I listed all of the elements but then focused on the actual conduct.  Let me know if you hear something different.  Sue

Hey Sue,
I haven't heard from anybody else. I too, am focusing on the IIED issue, and disregarding the reset. I didn't know if he wanted the other issues addressed at all. I think you're right though. Just the conduct and disregard the rest. Thanks for the reply.
